By placing an order with Webbex Internet, you confirm that you are in agreement with and bound by the terms and conditions listed hereunder.
Definitions:
(a) “The Client” means the company, organisation or individual requesting the services of Webbex Internet.
(b) "Webbex Internet" means the employees, agents or sub-contractors employed by Webbex Internet to carry out the works.
(c) “The Agreement” means the contract between Webbex Internet and the Client to which these conditions apply. Webbex Internet will carry out work only where an agreement is provided either by email, telephone, mail or fax.
(d) “Order” is the request by the Client for products and/or services quoted for by Webbex Internet. An “order” is deemed to be a written or verbal contract between Webbex Internet and the client.
(e) “Completion of works” means 5 days from the site being uploaded to a temporary site on the server of Webbex Internet, for approval by the client, without notification from the client that the site is unsatisfactory.
Scope: This agreement shall apply to all goods and/or services ordered by the client from Webbex Internet.
Payment: Webbex Internet reserves the right to request an advance payment of 25% of the total fee prior to commencement of the works, unless otherwise agreed, in which case payment is due upon completion of the works. Whilst any payment due under the agreement remains outstanding, Webbex Internet shall be entitled at its sole and absolute discretion to withhold provision of any goods or services it would otherwise be obliged to provide under the agreement. All payments must be made in pounds sterling. All works remain the property of Webbex Internet until all outstanding amounts are paid in full. Non-payment will result in legal action being taken if necessary.
Liability: Webbex Internet hereby excludes itself, its employees and/or agents from:- all and any liability for loss or damage caused by any inaccuracy,
omission, delay or error, whether the result of negligence or otherwise in the production of the works ordered; all and any liability for loss or damage to clients’
artwork/photographs/audio/video or any other items supplied for the completion of the works, whether the result of negligence or otherwise.
Copyright: Any website designed by Webbex Internet carries a copyright, and cannot be reproduced without written consent. The placing of an order by the
client or other person/agency on behalf of the client, constitutes a guarantee that all necessary authority and permissions have been obtained in respect of the artwork,
design, photographs, audio or video that is being used.
Where Webbex Internet have been asked to work with audio or video material, the client must own the copyright to this material. Should any copyright subsisting in the work not be owned entirely by the client instructing the work, it is the responsibility of the client to obtain consent for the reproduction of the work from the copyright owner.
Completion of the Works: On completion of a website or design works, the works will be uploaded to the client area of Webbex Internet' server for approval. Upon approval by the client, the website will then be uploaded to the client's server. On completion of other works said works shall be provided in CD-R or DVD-R format or another agreed format.

Design Credit:
Webbex Internet reserve the right to install a small link either by small type or by a small graphic at the bottom of a client's Web site. If a graphic is used, it will be designed to fit in with the overall site design.
Guarantee: Where bugs, errors or other issues are found after any works have been completed and paid for, Webbex Internet will endeavour (but is not
obliged) to correct these issues to meet the standards of function outlined in the brief. Whilst every effort will be made to ensure that the works are free of errors, Webbex Internet cannot accept liability for any losses incurred due to malfunction of the works or any part thereof.
Availability of Service: Where a client's website is being hosted by a third party, Webbex Internet will not be liable for any costs incurred, compensation or loss of earnings due to the interruption of this service.
Acceptance of Conditions:
The placing of an order will serve as acceptance of the aforementioned conditions.
Law: These conditions and all other express terms of contract shall be governed and construed in accordance with the laws of England.
